A foreign person for additional foreign acquirer duty (AFAD) includes:

foreign individuals
foreign corporations
trustees of foreign trusts.

You are a foreign individual if you are not an Australian citizen or permanent resident. A permanent resident holds a permanent visa, or is a New Zealand citizen with a special category visa, as defined by the Migration Act 1958 (Cwlth).

Is a home concession being claimed? *

Home concession

A reduction in the amount of transfer duty you pay when you purchase a home to live in

There are 4 types of home concession:

home concession—for your second or subsequent home
first home concession—for your first home (other than a new home)
first home (new home) concession—for your first home that is a new home
first home vacant land concession—for vacant land on which to build your first home.

You can claim one concession for your home.

First home

The first residence you acquire to live in (within 1 year of the transfer date)

If your first home is not a new home (i.e. it has previously been occupied, sold or transferred as a residential property before your transaction) you may be eligible for a transfer duty first home concession.

New home

A new home is:

a home that has not been previously occupied or sold as a place of residence

or

a substantially renovated home.
