Under section 105A of the Duties Act 2001, a concession is available for the transfer of assets used in certain businesses from an ancestor of the transferee.

An ancestor is the transferee’s or their spouse’s parent or grandparent, or the spouse of the parent or grandparent.

Is the business property being given wholly or partly as a gift?

What is the relationship of the transferor (or person directing the transfer) to the transferee or the transferee's spouse?

Parent or their spouse
Grandparent or their spouse
Neither of the above

Is the transferee acquiring the business property as trustee?

Is the beneficiary of the trust a minor who is a descendant of the person creating the trust?

Are there other beneficiaries of the trust, other than a person who would become a beneficiary on the death of the minor?

Was the business being carried out by the ancestor (alone or with others)?

Will the business be carried on by the transferee (alone or with others)?

Does the unencumbered value of the business property exceed $500,000?

The value of the business property includes the total of any gifts of property (used for the business) received by the transferee since 12 December 1984.

No concession

Based on the information that you have provided, a family business concession will not apply.

Family business concession
