Top tips for transfer duty self assessors

    These tips will help you meet your self assessor obligations when lodging transfer duty transactions using QRO Online.

    Our transfer duty toolkits give you everything you need to assess specific transactions. Here, we give you some tips on assessing caveats, leases and mortgages.

    You cannot self assess caveats by way of equitable mortgagee dated before 1 July 2008—these must be lodged with us for assessment.

    All general caveats, and caveats by way of equitable mortgagee dated after 1 July 2008, are not dutiable and do not need to be stamped.

    In most cases, you do not need to stamp a lease because lease duty was abolished on 1 January 2006. However, leases entered into on or before 1 January 2006 may still be dutiable.

    You can lodge these documents directly with Titles Queensland without a stamp:

    • a lease for a term commencing on or after 1 January 2006
    • an amendment of lease increasing the lease term, where the amendment commences on or after 1 January 2006
    • an amendment of lease increasing the rental, where the amendment commences on or after 1 January 2006
    • an amendment of lease amending the covenants only.

    You generally do not need to stamp a mortgage because mortgage duty was abolished on 1 July 2008. However, mortgages entered into on or before 1 July 2008 may still be dutiable.

    You can lodge these documents directly with Titles Queensland without a stamp:

    • a mortgage signed on or after 1 July 2008
    • a loan agreement
    • a release of mortgage
    • a caveat signed on or after 1 July 2008.

    When entering a name in QRO Online, both a surname and first name are mandatory. If a party to the transaction uses 1 name only (e.g. no first name) or another variation, you’ll need to call us on 1300 132 685 for instructions on how to enter their details.

    Transactions involving a party using one name only are currently out of scope for eConveyancing.

    You need to include all transferees of a transaction in the transferee section. Select the transferee type from the drop-down list and enter the details. You can then click Add transferee and repeat the process until all transferees have been added.

    Make sure you enter all required transferee information:

    • Individuals—first name, middle name, last name, date of birth and full address
    • Companies—company name, ABN and full address
    • Trusts—full name of trust and details of all trustees (including their first, middle and last names), date of birth and full address.

    In QRO Online, interest acquired is shown as a fraction.

    Enter:

    • 11 to transfer a whole share
    •  12 to transfer a half share.

    You can view a submitted transaction and print the statement summary.

    1. Select Lodgements from the side menu.
    2. Click the Advanced search icon and search for the transaction.
    3. Select View form next to the relevant transaction.
    4. Click the PDF icon at the top-right of the screen to view, print or save the statement.

    If you have made a data entry error in a submitted transaction, select Submit enquiry in QRO Online (under the relevant self assessor account), complete the details and click Submit enquiry. We will correct the error.
